Creation of a mortgage in the Czech Republic: step by step

A Czech manufacturer borrowing against its production hall discovers that the bank's approval is conditional on the mortgage being entered in the land register within a fixed window after signature. The loan is agreed, the funds are due to move, and the filing has not yet reached the register. The owner assumed the mortgage existed once the parties signed; it does not, and the gap between agreement and entry is where the financing window is lost.

Creation of a mortgage in the Czech Republic, step by step, means a written mortgage agreement followed by a filing with the land register, which alone gives the mortgage its priority – from the date of entry, not the date of signature. Until the register acts, no mortgage exists against third parties, whatever the contract says.

This page sets out who files where, the deadlines that govern the process, the file the register expects, and the point at which an owner must act, wait, or stop before signing.

What actually creates a mortgage on Czech real estate?

A mortgage in the Czech Republic is created by an agreement and completed only by entry in the land register; the agreement alone binds the two parties to each other but gives no priority against anyone else.

The mortgage agreement identifies the property, the secured debt and the parties, and is concluded in writing. Signature creates an obligation between the owner and the creditor. It does not create an encumbrance that a later buyer or a second creditor must respect. That step happens only when the cadastral office enters the mortgage in the land register. Until then, a second charge on the same asset, agreed before the first entry lands, can take priority instead – the order of filing at the register decides which mortgage ranks first, not the order of signature.

For an owner who has already treated the signed agreement as binding on the world, this sequencing is where a financing window closes. A lender that made the mortgage a condition of drawdown treats an unentered charge as no security at all, and a competing filing lodged first keeps its priority regardless of which agreement is older. A fuller picture of how Czech law treats real estate used as security shows why the mortgage sits alongside other charges that follow the same registration logic.

When does this apply to your situation?

The procedure applies whenever a debt is to be secured by immovable property: a bank loan, a shareholder loan, a supplier's extended credit, or a settlement converting an unpaid claim into a charge on an asset. The conditions differ mainly in what proof of the underlying claim the register will accept.

It does not apply where the parties intend only a lease of premises with a right of first refusal, or an unsecured undertaking – neither creates a mortgage, and neither is entered as one, whatever label the contract uses.

Before filing, the owner should run a title check: is the property owned outright, is it held jointly, is it already carrying a charge that limits a further one, and does its record in the land register match what the loan agreement describes. A mismatch between the cadastral description and the contract is one of the most common reasons an otherwise correct filing is returned rather than entered, and every return adds a queue position lost, not a queue position kept.

A signed mortgage agreement and a registered mortgage are two separate legal facts, and only the second one binds anyone beyond the two signatories.

An owner who signs a mortgage agreement without confirming the register's queue position is financing against a date that may not hold. Creation of a mortgage in the Czech Republic: what is the route, step by step?

The route runs from a written agreement, through a filing at the land register, to an entry the register either makes or rejects within a period set by law. There is no interim status between filed and entered.

A foreign lender's filing was once returned for a property description that did not match the register, and the correction cost the mortgage its original priority date (winter 2025). A priority date, once lost to a later filing, cannot be restored by re-filing under the old agreement. Where the underlying debt is not repaid, it is this entry that allows enforcement against the real estate to proceed against the specific asset rather than the debtor generally.

What must the file contain?

The land register accepts a filing only if the ownership record, the mortgage agreement and the identifying data of the property line up exactly. Missing or mismatched documents are the single largest cause of returned filings.

A Czech manufacturer's mortgage entry gained several weeks of priority after the title check was run before the agreement was signed, not after it was returned (spring 2025). Where the owner has signed the agreement personally rather than through the company, an incomplete file does more than delay the entry – it can leave that individual exposed to personal liability for the underlying debt until the corporate mortgage is actually in place.

The register does not ask whether the deal is fair; it asks whether the file, as filed, matches what the land register already shows.

A filing returned for a mismatched description does not just cost time – it can cost the priority date the loan was structured around. LISTINA sets out, before the agreement is signed, what the land register currently shows and what the filing will need to match, with delivery in a stated range of working days – write to info@listinafirm.com. Act, wait, or stop: the decision point

Before the mortgage agreement is signed, the owner is at the point where the title check, the corporate approvals and the register's current record either confirm the deal is filing-ready, or reveal a defect that is cheaper to fix now than after a return.

A title check against the land register shows what is entered on the day it is run. It does not show a filing lodged the same day but not yet processed, a family or matrimonial claim that has not reached the record, or a defect the register itself has not yet flagged. Before the matter starts, these are the limits of what documents and registers can establish.

A structured overview of what a given asset's record actually shows is the starting point for deciding whether to act now, wait for a document, or stop and correct the file before it is lodged.

Frequently asked questions

Where is creation of a mortgage filed?

The filing goes to the land register, at the branch that holds the file for the specific property, not to a general court. The property's cadastral location, not the parties' domicile, determines which branch is competent.

How long does the court take?

The land register examines the filing within a period fixed by law and, absent a defect, makes the entry once that period has run. There is no calendar date fixed in advance; the period runs from the day the filing is received.

Can the other side object?

There is no adversarial hearing at this stage; the register checks the filing for formal correctness, not for a dispute between parties. An owner who disputes the mortgage after entry must raise that separately, and the entry itself is not undone by a later disagreement.

What follows the decision?

Once the entry is made, the mortgage exists as a right against the property, ranking from the date of entry, and the owner and creditor receive confirmation of the new record. Any later dealing with the property, including a sale or a further charge, must then account for this entry.
